Welcome to this course designed to teach Quantity surveyors, engineers, Project Managers and construction management professionals the basics of contract management and construction contracts. The course covers all of the fundamentals you’ll need to walk away with a good understanding of construction contracts.
Construction contracts protect both parties in the agreement. These documents detail what work will be completed, when it will be completed and how much it will cost. They also outline methods of communication and how disputes will be handled if they arise.
In general, contracts provide duties and obligations the parties have agreed to but also provides protections for the parties if they fail to abide by their obligations. Construction contracts include details about the project and the work that will be done and how compensation will be handled related to the project.
Well-drafted contracts provide you and your business many benefits such as: Clarity in business relationships, agreements, and rights of parties. Avoiding potential contract disputes and litigation.
Anyone can draft a contract on their own and as long as the elements above are included and both parties are legally competent and consent to the agreement, it is generally lawful. However, lawful and legally binding may be two different things.
